A family Halloween celebration outside a Brooklyn police stationhouse turned to chaos on Thursday afternoon when a drunk driver ploughed onto the sidewalk and into the crowd, injuring six people, including three children. The Bushwick Halloween crash happened at the New York Police Department's 83rd Precinct "Trunk or Treat" event, where children in costumes had gathered to collect candy from decorated car trunks. Police say the driver, 56-year-old Michael Marsh, had a blood alcohol level of .26, more than three times New York's legal driving limit, when his vehicle mounted the sidewalk on Knickerbocker Avenue and struck pedestrians and a parked ambulance.

All six victims were taken to hospital and were listed in stable condition, the NYPD said. They included a 31-year-old woman and her two daughters, aged 6 and 11, an 8-year-old boy, a 74-year-old woman and a 53-year-old woman. Marsh, a Crown Heights resident, was arrested at the scene and charged with vehicular assault, reckless endangerment and a string of driving offences. The crash, two days before Halloween itself, has put a harsh spotlight on drunk driving at a weekend when millions of children will be out trick-or-treating after dark.

What Happened

The crash happened just before 4 p.m. on Thursday, October 29, outside the 83rd Precinct stationhouse on Knickerbocker Avenue near Bleecker Street in Bushwick, according to police and local television reports. The precinct was hosting its "Trunk or Treat" event, a community Halloween gathering at which families walk between parked cars with decorated trunks handing out candy. Children in costumes, parents and officers were on the sidewalk when the vehicle veered off the road.

According to the NYPD, the vehicle struck six pedestrians and a private ambulance that had been stationed outside the event. CBS New York reported that the impact pushed the ambulance into two other vehicles. Early reports differed on the vehicle itself: the New York Post described a van, while CBS New York described a black sedan. Police have not yet publicly resolved that detail, and the investigation into exactly how the vehicle left the roadway remains ongoing.

The six injured people were spread across three hospitals, the NYPD told reporters. A 74-year-old woman and an 8-year-old boy were taken to Wyckoff Heights Medical Center; a 31-year-old woman and her daughters, aged 6 and 11, were taken to Bellevue Hospital; and a 53-year-old woman was taken to Elmhurst Hospital Center. All were listed in stable condition. The names of the injured have not been released by officials.

Officers were on hand within moments because the crash happened outside their own stationhouse, and Marsh was taken into custody at the scene. His 46-year-old passenger was also initially detained. The New York Post, citing authorities, reported the passenger was expected to receive a summons for a traffic infraction; Fox 5 New York later reported the passenger was not facing any charges at this time.

Background/Context

"Trunk or Treat" events have become a fixture of Halloween in New York City and across the United States, organised by schools, churches and police precincts as a contained alternative to door-to-door trick-or-treating. Cars park in a row or a lot with their trunks decorated — pumpkins, ghosts, cobwebs, lights — and children collect candy trunk by trunk, usually with adults and officers close by. The 83rd Precinct event was one of many such gatherings held in the days running up to Halloween, which this year falls on Saturday, October 31.

That timing is part of why the crash has drawn so much attention. Halloween is one of the most dangerous nights of the year for pedestrians, especially children, because trick-or-treating happens after dark, costumes can limit visibility, and celebrations often involve alcohol. Safety groups urge drivers to slow down in residential areas, watch for children darting between parked cars, and arrange a sober ride before drinking. This weekend carries an extra wrinkle: daylight saving time ends at 2 a.m. on Sunday, November 1, when clocks fall back an hour, and AAA has urged drivers, parents and party hosts across the country to plan safe transport in advance for a Halloween weekend that runs straight into the clock change.

New York sets the legal blood alcohol limit for drivers at .08. A reading of .26, the level law enforcement sources gave for Marsh, is more than three times that limit and is consistent with heavy intoxication. Prosecutors in New York treat crashes in which a drunk driver injures someone seriously as vehicular assault cases, among the most serious driving charges short of a fatality.

Bushwick Halloween Crash: The Charges Against Michael Marsh

Marsh, 56, faces a long list of charges, police said. The headline charge is vehicular assault, reflecting the serious injuries suffered by the victims. He was also charged with reckless endangerment, three counts related to driving while intoxicated or impaired, driving on the sidewalk and driving without a seatbelt. The precise breakdown of the three intoxication-related counts has not been published in full, and police said further charges could follow as the investigation continues.

Police also gave a glimpse of Marsh's history. He has no recent criminal record in New York City, according to police sources, but he was arrested three times for robbery in 1999. That history, nearly three decades old, is not connected to Thursday's crash in any reporting so far, but it is part of the background police have released about the man now facing the vehicular assault charge.

What police have not done is describe the crash as deliberate. No reporting from the NYPD or the outlets covering the case suggests Marsh set out to hit the crowd, and the charges filed so far are driving and intoxication charges, not assault-with-intent charges. The distinction matters for how the case will be prosecuted: vehicular assault in a drunk-driving case turns on intoxication and serious injury, not on proof that the driver intended to hurt anyone.

Reactions/Quotes

Witnesses described a scene of panic as the vehicle came onto the sidewalk. One mother who had attended the event with her 9-year-old daughter told the New York Post she saw a young girl with a badly injured arm and other victims hurt on the ground, including a woman with a leg injury and another woman with a head injury. Her account, given at the scene, underlines how close the crash came to the children the event was organised for.

Police statements so far have been factual rather than emotive: six people struck, all stable, one driver arrested, charges filed. The NYPD has not released the victims' names, and no family member of the injured has spoken publicly in the reporting so far. That restraint is standard while victims, including three children, are still being treated and while investigators piece together the vehicle's path.

The wider reaction, in coverage of the crash, has centred on the .26 reading. A driver more than three times the legal limit getting behind the wheel in the middle of the afternoon, outside a police station, at an event full of children, is the detail that has travelled furthest. It has also fed the usual Halloween-weekend warnings from police departments and safety groups: if you drink, do not drive, and if you are driving on Halloween night, expect children on the streets.

Why It Matters

It matters first because six people, half of them children, were hurt at an event designed to keep children safe. Trunk-or-treat gatherings exist precisely so families can celebrate Halloween in a supervised, contained space rather than on open roads. A drunk driver reaching the sidewalk outside a police stationhouse shows the limits of that containment when a vehicle, rather than a stranger, is the danger.

It matters second because of the timing. The crash happened on the Thursday before Halloween, and the main night of trick-or-treating is Saturday, October 31. Every police department in the country will be repeating the same message this weekend: slow down, stay sober, watch for children. The Bushwick crash gives that message a fresh and painful example, and it is likely to be cited by officers and safety campaigners through the weekend.

It matters third for the legal story that follows. Vehicular assault cases turn on medical evidence about the victims' injuries and on proof of intoxication, and the .26 reading, if confirmed in court, will be central to the prosecution. The case will also test how quickly a drunk-driving prosecution can move when the victims include children and the crash happened in full view of a police precinct.

Finally, it matters for the families. The victims' names have not been released, and their recoveries will take longer than a news cycle. A 31-year-old woman and her two young daughters were hurt together, and three children in total are now recovering in hospital beds instead of planning their Halloween costumes. That human cost, more than the charges, is what will stay with the neighbourhood.

What Happens Next

Marsh's case will now move through the Brooklyn courts, where prosecutors will formalise the charges and a judge will set bail and hearing dates. Investigators will continue to reconstruct the crash: the vehicle's speed and path, whether it struck the ambulance before or after hitting pedestrians, and the full toxicology picture behind the .26 reading. Police have said the investigation remains ongoing.

For the victims, the next steps are medical. All six were stable when last reported, but stable is a hospital status, not a prognosis, and the seriousness of individual injuries has not been detailed publicly. Updates on their condition are likely to come through the NYPD or the hospitals rather than through family statements, given that three of the victims are children.

For the wider city, the next test is Saturday night itself. Halloween falls on a Saturday this year, with the clocks going back early Sunday, and police precincts across New York will again host trunk-or-treat events and patrol trick-or-treating routes. Whether Thursday's crash changes how those events are laid out — barriers, street closures, vehicle separation — is a question precinct commanders will have to answer quickly.

Drivers, meanwhile, face the simplest message of the weekend: do not drink and drive, and on Halloween night, drive as if a child could step out from behind any parked car. In Bushwick on Thursday, that warning came too late for six people.
