An Albuquerque mother has been charged with murder after police say her 10-year-old son fatally shot a 16-year-old girl during a dispute between neighbours over loud music at an apartment complex. Elaina Gomez-Villeda, 40, was charged on Sunday, a day after the Halloween-afternoon shooting in the 200 block of Tennessee Street, in the city's southeast, left Keinerlein Rangel dead and set off a second, separate investigation into an officer's gunfire at the same scene.

According to the Albuquerque Police Department account reported by local outlets, the confrontation began when Gomez-Villeda went to a neighbouring apartment to complain about the volume of music. What followed, police say, was a physical fight, a child sent inside to fetch a handgun, a single fatal shot, and then a chaotic confrontation with arriving officers in which the mother emerged from the apartment armed. The charges against Gomez-Villeda are allegations, not convictions, and the homicide investigation is continuing.

Key Points

• Elaina Gomez-Villeda, 40, was charged on Sunday, November 1, with an open count of murder over the death of Keinerlein Rangel, 16.
• Police say the shooting happened at about 4 p.m. on Saturday, October 31, in the 200 block of Tennessee Street, Albuquerque, after a dispute over loud music.
• Detectives allege Gomez-Villeda told her 10-year-old son to go inside and get her handgun; the boy returned outside and fired one shot, killing Rangel.
• The boy has not been charged and is not being identified; police say they are working with prosecutors on whether any charge is possible given his age.
• An officer fired at Gomez-Villeda as she left the apartment armed; the rounds missed and hit a pillar, and no one was hurt by that gunfire.

What Happened

Police were called to the apartment complex at shortly after 4 p.m. on Saturday, October 31, after reports of a shooting near Tennessee Street and Copper Avenue NE. By the time officers arrived, a teenager was dead at the scene, and the incident was still unfolding. The first published accounts, from Albuquerque outlet ABQ RAW and radio station KKOB, both draw on the police account and a criminal complaint reported by local ABC affiliate KOAT, and they agree on the sequence that detectives say led to the killing.

Gomez-Villeda, according to that account, went to a neighbouring apartment to complain about loud music. She became involved in a physical fight with Susana Rangel, the mother of Keinerlein Rangel. Susana Rangel told police her daughter tried to intervene, and that Gomez-Villeda then started hitting the teenager. Gomez-Villeda's 10-year-old son also tried to intervene, police say, and it was at that point, detectives allege, that his mother told him to go inside the apartment and get her handgun.

The boy did so, returned outside with the gun, and fired one shot, striking and killing Keinerlein Rangel, according to police. Gomez-Villeda then took her son inside their apartment and closed the door. She later told detectives she had texted her husband, "I'm probably going to jail right now," and she called 911 to report the incident. She also told detectives she had been attacked by her neighbours after she complained about the music — an account detectives are weighing alongside the other witnesses' statements as the investigation continues.

While Gomez-Villeda was on the phone with 911, she told detectives, a man tried to pull open her door and broke her window. That man was later identified as Keinerlein Rangel's father, who had arrived at the apartment after the shooting and been told by his wife that his daughter had been shot. Gomez-Villeda told detectives she grabbed a gun and shot at the man to make him leave, saying: "I thought we were gonna die; these people, they do it a lot, and I didn't think I was gonna be the target, but it is what it is."

When officers arrived, they saw someone shoot a gun from inside the apartment and took cover. Three people eventually came out of the apartment, followed by Gomez-Villeda, who was armed with a handgun. One officer fired his handgun toward her, but the rounds missed her and struck a pillar on the apartment building. No one was injured by the officer's gunfire, police said, and Gomez-Villeda then dropped the handgun and surrendered. Whether she was holding the same firearm her son had used, or a different weapon, has not been determined, according to police.

Background and Context

The victim was first reported by police as 17 years old. Albuquerque police clarified on Sunday that she was 16, and ABQ RAW published an editor's note correcting its earlier figure. That correction matters, because the first day of coverage carried both ages, and the clarified age — 16 — is the one now used in the charging reports. The victim's name, Keinerlein Rangel, was released by police and reported by local outlets; the 10-year-old boy is not being named because he has not been charged with a crime.

The shooting happened on Halloween afternoon, in a part of southeast Albuquerque that local coverage has long called the War Zone, near Tennessee Street between Copper Avenue and Chico Road. It was, by police's account, a neighbour dispute that escalated in minutes from a complaint about music to a fistfight involving adults and children, and then to a fatal shooting. No motive beyond the loud-music dispute has been offered by police, and no account yet published suggests the two families had a prior violent history — only Gomez-Villeda's own reported remark that confrontations of this kind happened often in the area.

The case also arrives in a state that has debated child access to firearms for years. New Mexico's Bennie Hargrove Gun Safety Act, named after a 13-year-old killed by a classmate in 2021, requires firearms to be stored securely and away from children, and local coverage of this shooting has already raised questions about whether that law could feature in the case. Gomez-Villeda has not, in the reports published so far, been charged under that act by name. The charge that most directly covers the same ground is negligently making a firearm accessible to a minor, one of the seven counts she now faces.

Albuquerque Mother Charged: The Charges Explained

The full list of charges reported against Gomez-Villeda is: an open count of murder; conspiracy to commit murder; child abuse; contributing to the delinquency of a minor; negligently making a firearm accessible to a minor; misdemeanor battery; and receiving stolen property, in this case a firearm. An "open count" of murder in New Mexico means prosecutors have charged murder without specifying a degree at this stage, leaving the degree to be determined as the evidence develops.

Taken together, the charges tell a story about how prosecutors see her role. The murder and conspiracy counts allege she was criminally responsible for the killing itself, not merely present when it happened. The child-abuse and delinquency counts allege she endangered and involved her own son. The firearm-access count alleges she failed to keep the gun from a child. And the receiving-stolen-property count alleges the firearm itself was stolen property — a claim that, if proved, would add a separate layer to the case and raise further questions about how the gun came to be in the apartment.

None of that has been tested in court. Gomez-Villeda was reported by one outlet, citing jail records, to be held without bond at the Metropolitan Detention Center. No plea has been reported, and no court date has yet been published in the coverage so far. Until a court hears the case, the police account remains an allegation, and the defence has not yet had a public opportunity to answer it in detail.

Reactions and Quotes

Police have released the account in stages, first through a scene briefing by Chief Cecily Barker on Saturday and then through the charging announcement on Sunday. At the scene, Barker described a teenager who had been trying to break up an altercation involving the boy's mother, and a boy who first tried to get his mother to go back inside before later returning with a firearm. The chief's account matches the later charging reports in its essentials: a dispute over music, a physical fight, a child fetching a gun, and a single fatal shot.

The most striking words in the case so far are Gomez-Villeda's own, as reported to detectives. Her text to her husband — "I'm probably going to jail right now" — was sent, she told detectives, after she had taken her son back inside. Her explanation for firing at the victim's father — "I thought we were gonna die; these people, they do it a lot, and I didn't think I was gonna be the target, but it is what it is" — will likely be central to how both sides frame what happened after the fatal shot, when the confrontation moved from the courtyard to the apartment door.

Susana Rangel's account, as reported, is simpler and grimmer: her daughter tried to stop a fight and was hit, and then shot. The two mothers' versions agree that a fight happened and that the teenager intervened. They differ on who attacked whom first, and on what justified the gunfire that followed. Those differences are now for investigators and, eventually, a court to resolve.

Why It Matters

This case matters for three reasons, each of which goes beyond a single apartment courtyard. The first is the age of the child said to have fired the shot. A 10-year-old is below the age at which New Mexico law ordinarily treats a child as criminally responsible, which is why police say they are consulting the district attorney's office and state officials about whether any charge against the boy is even possible. Whatever they decide, the boy's future — and the question of what support or supervision follows a child involved in a killing — will be watched closely.

The second is the adult's alleged role. If prosecutors prove that a mother directed her young son to fetch a gun during a fight, the case becomes a test of how far adult responsibility extends when a child pulls the trigger. The combination of murder, conspiracy and child-abuse charges shows prosecutors are pursuing that theory aggressively, rather than treating the shooting as an accident or as the child's act alone.

The third is the officer-involved shooting, which is being investigated separately by a Multi-Agency Task Force, as is standard in New Mexico when an officer fires a weapon. That investigation will examine whether the officer's decision to fire at an armed woman emerging from an apartment where shots had just been fired was justified, and whether anything about the response could have been handled differently. Its findings will be published separately from the homicide case, and the two inquiries could reach different conclusions about different moments of the same afternoon.

What Happens Next

Homicide detectives say they will continue investigating the death of Keinerlein Rangel, and the Multi-Agency Task Force will continue its separate investigation into the officer's gunfire. The next public steps to watch are the charging documents themselves, which should confirm the precise wording of each count, and Gomez-Villeda's first court appearance, where a plea is expected to be entered and bond conditions addressed. No date for either has been published yet.

Also unresolved is the question of charges against the boy. Police have said only that detectives are working with the district attorney's office and state officials to determine what, if anything, can be charged given his age. That decision may take days or weeks, and it may conclude that no charge is legally available — a result that would leave the adult prosecution as the only criminal case arising from the killing.

Finally, the firearm itself will be examined. Investigators will want to establish whether the gun the boy used was the same one Gomez-Villeda later carried out of the apartment, whether it was indeed stolen property as the receiving charge alleges, and how it was stored before the fight. Those answers could shape both the firearm-access charge and any further charges under New Mexico's safe-storage law.
