Abortion ballot measures are on the ballot in four states on Tuesday, 3 November 2026, and the results could move abortion law in opposite directions at once. Idaho, Nevada and Virginia are voting on measures that would protect abortion access, while Missouri is voting on whether to repeal a constitutional abortion protection its own voters approved only two years ago. The votes land on the same day Americans decide control of Congress, 35 Senate seats and 36 governorships,

Key Points

• Idaho Proposition 1 would end the state's near-total abortion ban and allow abortion until fetal viability.
• Nevada Question 6 would put abortion rights, up to viability, into the state constitution in a required second vote.
• Virginia Question 1 would add a constitutional right to reproductive freedom, covering abortion, contraception and fertility care.
• Missouri Amendment 3 would repeal the abortion-rights amendment passed in 2024 and replace it with a ban with limited exceptions.
• In Idaho, Nevada and Virginia, a yes vote protects abortion access; in Missouri, a yes vote would remove the existing protection.

What Happened

Voters in the four states are deciding abortion measures alongside the midterm elections, but the measures differ in legal force. Virginia and Nevada are voting on constitutional amendments, Idaho is voting on a statute, and Missouri is voting on a constitutional amendment that would undo an earlier constitutional amendment.

The contrast is sharpest in Missouri. In November 2024, it became the first state to overturn a near-total abortion ban by popular vote, passing its abortion-rights amendment with about 52 per cent of the vote. The measure now on the ballot carries the same name, Amendment 3, but would do the opposite. Its replacement would ban abortion except in medical emergencies, for fatal fetal anomalies, and in cases of rape or incest before 12 weeks. It would also require parental consent for minors, bar most public funding, and ban gender transition procedures for minors.

Background: Four Years After Dobbs

Since Dobbs overturned Roe v. Wade in 2022, voters in 16 states have weighed in directly on abortion. Ten states have enshrined abortion rights in their constitutions, while voters rejected restrictions in Kansas, Kentucky, Montana and South Dakota.

Ballot wins have also not always meant immediate change. In Missouri, surgical abortion resumed in 2025 after court rulings, but medication abortion only returned in June 2026, the first time it had been available from a Missouri clinic since 2018.

Abortion Ballot Measures: What Each State Is Deciding

Idaho, Proposition 1. Idaho bans abortion at nearly every stage, with felony penalties and no exception for a fatal fetal diagnosis. Proposition 1 would allow abortion until viability, usually between 23 and 25 weeks, and after that only in medical emergencies, while also protecting contraception, fertility treatment and miscarriage care. Because it is a statute, not a constitutional amendment, the legislature could repeal it, and the state Republican Party has already passed a resolution urging lawmakers to do so if it passes.

Virginia, Question 1. Virginia is the only Southern state without a total ban or an early gestational limit; abortion is legal into the third trimester, and after that only if three physicians certify it is necessary. Question 1 would add a fundamental right to reproductive freedom, covering prenatal care, childbirth, postpartum care, birth control, abortion, miscarriage management and fertility care. The state could still restrict third-trimester abortion, except when the patient's life or health is at risk or the pregnancy is not viable. If it passes, it takes effect on 1 January 2027.

Nevada, Question 6. Abortion is already legal in Nevada until 24 weeks, protected since a 1990 referendum. Question 6 would lift that right into the constitution. Nevada requires citizen-initiated amendments to pass in two consecutive general elections, and voters approved it in 2024 with 64.4 per cent. This is the second and final vote.

Reactions and Quotes

LaTwyla Mathias, executive director of Progress Virginia, said: "We trust that pregnant people can make the best decisions about their bodies and their families, and we trust healthcare providers to provide the highest standard of care." In Nevada, Lindsey Harmon of Nevadans for Reproductive Freedom said: "It's important to remember that this is about bodily autonomy and individual freedoms, so we believe that belongs in the state constitution."

Idaho supporters point to a shrinking pool of maternity doctors: Planned Parenthood Alliance Advocates said the state lost 35 per cent of its obstetrician-gynaecologists, 94 of 268, between 2022 and 2024, leaving just 23 across 37 of its most rural counties.

Opponents argue differently in each state. In Idaho, the "Stop Prop 1" campaign and the Church of Jesus Christ of Latter-day Saints say the measure would wipe out decades of anti-abortion law. In Virginia, Senator Glen Sturtevant and the Family Foundation argue the text, giving the right to "every individual" without an age limit, could override parental consent law; House sponsor Delegate Charniele Herring says it does not touch that part of the code. In Missouri, the No on 3 Stop the Ban campaign calls the exceptions too narrow to work in practice.

Why It Matters

These votes test two questions at once: whether the post-Dobbs run of abortion-rights ballot wins continues, and whether opponents have found a model for reversing a win. Missouri is the clearest test. An August Saint Louis University/YouGov poll found voters nearly evenly split, with 43 per cent supporting Amendment 3, 44 per cent opposing it and 13 per cent undecided.

What Happens Next

Results will come in through Tuesday night and, in close races, possibly later. A yes vote in Virginia would take effect on 1 January 2027, but opponents say they will keep fighting in court. A yes vote in Nevada would complete the two-election constitutional process. In Idaho, a yes vote would likely be followed by litigation and a repeal fight. In Missouri, a yes vote would trigger new court cases over how the ban and its exceptions are applied, while a no vote would leave the 2024 protection in place.

Frequently Asked Questions

Which states are voting on abortion on 3 November 2026? Idaho, Nevada, Virginia and Missouri. Three measures would protect access; Missouri's would restrict it.

What does a yes vote mean in Missouri? A yes vote for Amendment 3 in 2026 would repeal the abortion-rights amendment passed in 2024, the opposite of what a yes vote on Amendment 3 meant in 2024.

Why is Nevada voting on the same question again? Nevada requires citizen-initiated constitutional amendments to pass in two consecutive general elections. Question 6 passed in 2024 with 64.4 per cent; 2026 is the second round.

Could Idaho's legislature overturn Proposition 1 if it passes? Yes, because it is a statute, not a constitutional amendment, and the state Republican Party has already urged repeal.

When would Virginia's Question 1 take effect? On 1 January 2027 if a majority votes yes, although court challenges are expected.
