Democrats who swept both chambers of Congress in the November 3 midterm elections are preparing to turn immigration enforcement into the first great fight of the new Congress, using oversight powers they have lacked for two years to investigate ICE and the Department of Homeland Security. The Democrats immigration fight, reported by The Associated Press on Saturday, will test how far a new majority can go against a president who still holds the veto pen — and a White House that has just promoted Stephen Miller, the architect of the deportation agenda, to chief of staff.

Key Points

• Incoming Democrats will use House and Senate oversight to investigate ICE and the Department of Homeland Security once sworn in.
• Representative Robert Garcia, set to lead House Oversight, warned the administration to “lawyer up”; Representative Bennie Thompson said the next Congress will hold those responsible accountable.
• Probes could cover warehouse purchases to hold arrested immigrants, ICE hiring shortcuts, and deaths in detention facilities.
• An AP Voter Poll of more than 100,000 midterm voters found about 6 in 10 said enforcement had “gone too far”.
• Limits are real: Trump keeps veto power for two more years, deportation funding is frontloaded for three years, and Secretary Markwayne Mullin says “Deportations will continue”.

What Happened

The Associated Press reported on Saturday, November 7, that senior Democrats are drawing up plans to rein in the president’s mass-deportation machine as soon as the new Congress is seated in January. The centrepiece is oversight: hearings, document demands and subpoenas aimed at ICE and the Department of Homeland Security.

Garcia, a Democrat from the Los Angeles area who is in line to chair the House Oversight Committee, put the administration on notice in blunt terms. Thompson, the ranking Democrat on the House Homeland Security Committee, said the next Congress would “address the Trump administration’s assault on the rule of law and hold those responsible accountable”.

Garcia and Senator Richard Blumenthal previously held shadow hearings with families of people killed in enforcement operations and an ICE-training whistleblower. No Republicans attended, and without a majority the Democrats had no subpoena power. In January, that changes. The announcement came a day after the White House elevated Miller to chief of staff. Senator Alex Padilla of California called the promotion doubling down — and added, “So will we.”

Background and Context

Immigration enforcement defined the midterm campaign. The AP Voter Poll found about 6 in 10 midterm voters said enforcement had gone too far, a similar share disapproved of how ICE was doing its job, and about 6 in 10 said immigrants today do more to help the country than to hurt it.

The campaign has cut illegal border crossings to their lowest levels in decades, but it has also produced street confrontations in American cities, including two Americans shot dead in Minnesota last winter. The Wall Street Journal reported this week that Trump himself told aides Miller “had gone too far”, after First Lady Melania Trump complained that people she knew were being apprehended.

Democrats Immigration Fight: What Congress Can Actually Do

The oversight plans focus on three areas: warehouse purchases to hold arrested immigrants, whether ICE cut corners hiring thousands of new deportation officers, and deaths in ICE detention facilities — the subject of the shadow hearings Garcia and Blumenthal held with bereaved families. With subpoena power, committees can compel testimony and documents the administration has so far withheld, and public hearings would put the human cost of the campaign on television.

But oversight is not control. Trump remains in office for two more years with veto power. Republicans frontloaded ICE and Border Patrol funding for three years, and a summer 2025 package provided $150 billion for detention capacity, the border wall and thousands more officers. Mullin has vowed deportations will continue, and Miller’s promotion to chief of staff sends the same message from inside the West Wing.

Reactions and Quotes

Garcia’s warning to “lawyer up” was the sharpest line of the Democrats’ rollout. Thompson framed the effort as a defence of the rule of law. Padilla linked the oversight plans to Miller’s promotion, arguing that elevating the architect of the hard-line agenda amounts to doubling down — and that Democrats intend to answer in kind.

Senator-elect James Talarico of Texas went further, discussing comprehensive reform including a pathway to citizenship, while Representative Gabe Vasquez of New Mexico proposed a new visa class for care workers. The administration’s response has been unyielding: Mullin’s pledge that deportations will continue leaves no doubt the White House sees the midterm result as a setback to be ridden out, not a verdict to be obeyed. Trump himself has told aides Miller went too far, yet he has now put Miller in charge of his White House.

Why It Matters

This fight will define the first months of the new Congress. Immigration was the issue that moved the most voters in the midterms, and the AP poll suggests the public mood has turned against the way enforcement has been carried out, even as many voters still support firm borders. How Democrats handle the campaign will shape whether that mood hardens into lasting change.

It also matters for millions of people directly affected: immigrants in detention, families separated by arrests, and the officers carrying out the orders. Hearings that expose warehouse conditions, hiring shortcuts or detention deaths could force changes no bill could, simply by making the details public.

What Happens Next

The new Congress is sworn in on January 3, 2027, when Garcia is expected to take the Oversight gavel. Miller starts as chief of staff on Monday, November 9. Deportations will continue in the meantime, funded by money already appropriated.

Broader reform — Talarico’s pathway to citizenship, Vasquez’s care-worker visas — faces a much harder road. Any such bill would need Trump’s signature, and the president has shown no sign of offering one. For now, the fight will be fought in hearing rooms, not on the Senate floor. What did voters say about enforcement?
About 6 in 10 midterm voters in the AP Voter Poll said enforcement had “gone too far”, and a similar share disapproved of how ICE was doing its job.

Will deportations stop under the new Congress?
No. Homeland Security Secretary Markwayne Mullin has said deportations will continue, and funding for ICE and the Border Patrol was frontloaded for three years.
