Supreme Court Justice Sonia Sotomayor said on Saturday that she hopes the court will one day reverse the Trump immunity ruling, the 2024 decision that gave former presidents broad protection from prosecution for their official acts. Speaking at a public civics discussion at the Washington Library at Mount Vernon, Virginia, she named the immunity case first among the rulings she hopes to see overturned in her lifetime.

"There's some opinions that I hope in my lifetime will get overturned. The immunity case is one of them," Sotomayor said, to applause. "I'm hoping that the court will take back some of the crazy things that it's done. I'm only joking," she added — then paused. "Maybe not."

Key Points

• Justice Sonia Sotomayor said on Saturday, November 7, 2026, at Mount Vernon, Virginia, that she hopes the Supreme Court overturns its 2024 presidential immunity ruling in her lifetime.
• The 6-3 ruling in Trump v. United States held that former presidents have at least presumptive immunity from prosecution for official acts.
• Sotomayor wrote the dissent for the court's three liberal justices, warning the decision "makes a mockery of the principle, foundational to our Constitution and system of Government, that no man is above the law."
• She said the country is going through a "rough patch" on the rule of law and civic discourse, and expressed sympathy for teachers explaining the court's shifting jurisprudence.
• The remarks were her first public comments on the week's midterm elections, in which Democrats swept both chambers of Congress.

What Happened

Sotomayor was speaking at a public discussion on civics education at the Washington Library at Mount Vernon, the Virginia estate of George Washington, as part of a multi-day event marking the 250th anniversary of the United States. The setting was deliberate: a conversation about citizenship at the home of the nation's first president.

She said the United States is going through a "rough patch" on the rule of law and civic discourse, and expressed sympathy for teachers who must explain to their students what she called "systemic changes in my court's jurisprudence." She also addressed the week's midterm contests for the first time in public. Democrats swept both chambers of Congress in the elections held on Tuesday, November 3, 2026, a result that reshapes the political landscape in Washington.

Background and Context

The ruling Sotomayor hopes to see reversed is Trump v. United States, decided on July 1, 2024. By a 6-3 vote, the court held that former presidents have absolute immunity from prosecution for actions within their core constitutional powers, and at least presumptive immunity for other official acts. There is no immunity for unofficial acts, the majority said, but the line between official and unofficial conduct was left for the lower courts to draw.

The decision upended the federal case against President Donald Trump over his efforts to subvert the 2020 election, forcing it back to the lower courts. The prosecution was later dropped after Trump won the 2024 election. Sotomayor's dissent, joined by Justices Elena Kagan and Ketanji Brown Jackson, was unsparing: the decision "makes a mockery of the principle, foundational to our Constitution and system of Government, that no man is above the law," she wrote, closing: "With fear for our democracy, I dissent."

Trump Immunity Ruling: What the 2024 Decision Said

Chief Justice John Roberts wrote the majority opinion, joined by the court's five other conservative justices. The majority reasoned that a president must be able to act "boldly and fearlessly" without the threat of prosecution hanging over every decision. The court said the separation of powers required immunity for the president's core duties, such as commanding the military, and presumptive immunity for the rest of his official work.

The dissenters saw it very differently. Sotomayor argued that the decision gave the president a license to break the law while in office, so long as he could frame his conduct as official. She listed examples — ordering the assassination of a political rival, taking a bribe in exchange for a pardon, staging a military coup — and said the majority's logic would shield each of them. Sotomayor, 72, was appointed by President Barack Obama in 2009 and is the court's first Latina justice.

Reactions and Quotes

The most striking lines of the evening were Sotomayor's own. "There's some opinions that I hope in my lifetime will get overturned. The immunity case is one of them," she said, naming the case without being asked about it. No response from the court's conservative justices or from the White House was reported in the coverage of the appearance. A month earlier, Justice Elena Kagan made a similar warning about the court's conservative majority.

Why It Matters

It is rare for a sitting justice to say in public that she hopes her own court reverses one of its decisions. Sotomayor's remarks at Mount Vernon were a deliberate break with that norm, underlining how deep the court's internal divide has become. The immunity ruling matters because it remains the law: it shapes what any future prosecution of a president can look like, and a future court could revisit it only if a new case gives it the chance.

What Happens Next

No case currently before the Supreme Court asks it to revisit presidential immunity, and a reversal would require a new prosecution or lawsuit working its way up through the lower courts — a process that takes years. Sotomayor, who has given no sign of retiring, will remain on the bench to make her case from the inside, in dissents and in public.
