Attorney General Todd Blanche warned Democrats on the House Oversight Committee on Sunday that they should be "very worried", as he backed President Donald Trump's order for the Justice Department to investigate them, refusing to rule out criminal inquiries, or even prison, for lawmakers carrying out oversight.

Blanche spoke on CNN's "State of the Union" with Dana Bash on Sunday, November 8, 2026, a day after Trump wrote on Truth Social that Democrats were threatening officials, Republican donors and supporters with impeachment and imprisonment, calling it "extortion at the highest level" and ordering the Justice Department to "look into this criminal act, immediately!"

Key Points

• Blanche told CNN's Dana Bash on Sunday, November 8, 2026, that "there could be" investigations into Democratic lawmakers overseeing the Trump administration, and did not rule out imprisoning them.
• Asked what criminal act Trump meant, Blanche named none. Bash noted Democrats talking about investigation as part of oversight is "prescribed by the Constitution".
• Blanche singled out Representative Robert Garcia of California, the top Democrat and incoming Oversight chairman, who had told incoming chief of staff Stephen Miller to "lawyer up".
• "I would suggest he read the Constitution. If he doesn't have a copy, I can arrange to send him one," Blanche said, adding: "I would be very worried if I was a member on that committee."
• Garcia, on CNN immediately after Blanche, replied: "We're not going to be intimidated," and reminded viewers Blanche was Donald Trump's former personal lawyer.

What Happened

The interview came a day after Trump's post on Truth Social, in which he accused Democrats of threatening Blanche and others despite no wrongdoing, and singled out Senator Elissa Slotkin of Michigan, accusing her of threatening young Americans who support Republican values, without identifying specific remarks or providing evidence.

On CNN, Bash pressed Blanche repeatedly on what law Democrats had broken. He cited no statute or specific act, turning instead to Garcia's "lawyer up" remark, aimed at Miller. The central question went unanswered: what, exactly, would the Justice Department be investigating?

Blanche also appeared on Fox News Sunday the same day. Democratic oversight, he said, is "not the way this country can survive or live with these ongoing threats". And to officials facing Democratic scrutiny, he added: "if you work in this administration, you have a lawyer. It's me."

Background and Context

The clash follows the Democrats' midterm sweep on Tuesday, November 3, 2026, when they won both chambers. The new Congress convenes on January 3, 2027, and Garcia is set to take the gavel of the House Oversight Committee, one of Washington's most powerful investigative panels.

Democrats have outlined wide-ranging oversight plans, including the Trump family's business dealings, the Epstein files, the Iran war, and immigration enforcement. Garcia told officials to "lawyer up" after the election, and Democrats say subpoenas could come on the new Congress's first day.

Blanche was Donald Trump's personal lawyer before becoming attorney general, and defended Trump in criminal cases. Garcia raised that history on CNN, noting the department sent him a letter two years ago saying it would investigate him for comments on a CNN programme.

Todd Blanche: "I Would Be Very Worried"

The warning was aimed squarely at the committee that will soon have subpoena power over his department. "I would be very worried if I was a member on that committee," Blanche said, after suggesting Garcia read the Constitution — and offering to send him a copy.

Oversight is a core function of Congress: the Constitution gives lawmakers the power to investigate the executive branch, and both parties have used it for generations. Blanche did not explain how oversight, or telling an official to "lawyer up", could be a crime, nor say whether any investigation had been opened.

As of Sunday, the Justice Department had confirmed no investigation of Democratic lawmakers, and the White House had identified no specific criminal act. White House spokeswoman Lauren Bis said earlier in the week that sham investigations would work against the American people.

Reactions and Quotes

Garcia's response, minutes after Blanche left the CNN set, was defiant. "We're not going to be intimidated," he said, calling the attorney general's comments an attempt to scare Democrats away from oversight before the new Congress is seated.

He also turned Blanche's history against him, reminding viewers the attorney general was once Trump's personal lawyer — a point Democrats repeat as they argue the Justice Department has become a political instrument of the White House.

Why It Matters

It puts the attorney general on record declining to rule out imprisoning opposition lawmakers for doing their constitutional job. Oversight is one of Congress's oldest powers, and the threat of prosecution — even an unopened one — can chill it.

It also matters because of who is making the threat. The Justice Department is supposed to enforce the law without favour, and Blanche's dual role — once Trump's lawyer, now the nation's top law-enforcement officer — is exactly what Democrats say they will examine.

It also sets the tone for the new Congress. With Democrats taking both chambers in January, the fight over subpoenas, documents and testimony will be one of the defining battles of the next two years, and Sunday showed neither side will back down.

What Happens Next

The question now is whether the Justice Department opens any investigation at all. Trump ordered one on Saturday, but an order on social media is not the same as a criminal inquiry, and the department has said nothing since.

Stephen Miller takes over as White House chief of staff on Monday, November 9 — the day after Garcia's "lawyer up" warning was aimed at him. Garcia takes the Oversight gavel in January, when Democrats are expected to begin issuing subpoenas.

Watch for a Justice Department statement, Garcia's next moves, and whether the administration follows through on a threat that, for now, exists only in words on television and social media.
