Utah has filed 14 criminal counts against prediction-market operator KalshiEX LLC and its co-founders, alleging that sports wagers on the platform amount to illegal gambling under state law. The Utah Kalshi criminal charges, filed on October 28, 2026, name chief executive Tarek Mansour and chief operating officer Luana Lopes Lara as co-defendants, according to the Utah Attorney General's charging document.

The case rests on an undercover operation. A state investigator using a Utah address, telephone number and bank account placed 12 sports wagers totalling $114.87 on Kalshi between September 13 and September 26, 2026, on NFL, college football, MLB, MLS and NHL events, ending $25.10 out of pocket. Prosecutors say those bets support one second-degree felony count of engaging in a pattern of unlawful activity, 12 third-degree felony counts of online gambling promotion and one Class A misdemeanour count of gambling promotion.

Key Points

• Utah filed 14 criminal counts against KalshiEX LLC, Tarek Mansour and Luana Lopes Lara on October 28, 2026.
• The counts are one pattern-of-unlawful-activity felony, 12 online gambling promotion felonies and one misdemeanour promotion count.
• An undercover investigator placed 12 sports wagers totalling $114.87 in September 2026, losing $25.10.
• Mansour and Lopes Lara received summonses, not arrest warrants, and will answer in Utah's Third District Court in Salt Lake County.
• Kalshi says its contracts are federally regulated by the Commodity Futures Trading Commission; Utah says gambling is illegal in the state regardless of who places, runs or promotes it.

What Happened

Each wager is treated as a separate promotion count, with the pattern count tying them into an alleged course of unlawful activity. That turns small bets into a felony prosecution rather than a single low-level offence. Prosecutors have not alleged harm to any Utah customer beyond the investigator's $25.10 loss, and the charges are allegations that have not been proven.

Mansour and Lopes Lara were not arrested; they received summonses to appear in the Third District Court in Salt Lake County, which covers Utah's most populous county and its capital. No plea or hearing date was set out in initial reporting. The wagers came in September, during the early football season and baseball's closing stretch, when sports contracts draw heavy trading.

Background and Context

Kalshi runs a federally regulated exchange where users trade contracts tied to future events, from elections and economic data to sports results. Supporters argue such contracts are financial instruments, traded with central clearing and market surveillance. Critics, including several state gambling regulators, argue a contract paying out solely on a sporting result functions as a wager whatever the trading mechanism around it.

Utah is among the strictest states on gambling, with no state lottery and no commercial casinos and only narrow exceptions. Its reported position is that gambling is illegal whether a person places the bet, runs the game or promotes it, so a platform accessible to Utah residents can itself be an offence even if federally registered elsewhere. Other states have brought similar challenges, courts have reached different answers, and no nationwide rule has yet settled the question.

Utah Kalshi Criminal Charges: The Federal Clash

Two days before the state charges, on October 26, the United States government and the Commodity Futures Trading Commission sued Utah in federal court, arguing federal commodities law pre-empts state gambling laws as applied to Kalshi's contracts. District Judge Robert J. Shelby scheduled a hearing on the government's emergency motion for Friday, November 6, at 1:00 p.m. If the federal court grants interim relief, the state case could be paused; if it refuses, Utah's prosecutors can press ahead.

Pre-emption is powerful but not automatic. Federal law displaces state law where Congress has clearly occupied a field or state law directly conflicts with a federal scheme, but courts also preserve traditional state powers, including gambling regulation, unless the conflict is clear. Utah is expected to stress its long-standing ban; Kalshi and Washington are expected to argue a federally traded contract cannot be reclassified as a state gambling offence without undermining the national market.

Reactions and Positions

Utah prosecutors present the case as a straightforward application of state law: an investigator placed sports wagers from inside Utah, so the people and company behind the platform are answerable in Utah courts. The undercover transactions are designed to establish jurisdiction and show the platform was in fact accessible to Utah residents.

Kalshi's reported position is that its event contracts are federally regulated and therefore not state gambling, a defence now backed by the federal government's own lawsuit. The company has not, in initial reporting, addressed the specific wagers in detail. The federal intervention is unusual and signals the commission views state prosecutions as a threat to its authority, while state regulators may view Utah's case as a test of their remaining power.

Why It Matters

First, the case could define the legal status of sports prediction markets in the United States. A Utah win could embolden other states with gambling bans to bring their own cases, forcing platforms to block users state by state. A Kalshi win on pre-emption would give federally regulated exchanges a strong shield against state gambling law, potentially opening sports contracts nationwide regardless of local bans.

Second, it matters for consumers, who may not grasp which protections apply when a product blurs investing and betting. A regulated exchange offers clearing and surveillance an unlicensed sportsbook does not, yet exposes users to losses that feel like gambling losses. What Happens Next

The immediate step is the November 6 federal hearing before Judge Shelby. Watch whether the court grants interim relief, sets expedited briefing or leaves the state case untouched. Any order will be provisional but will shape the pace of both cases.

In state court, Mansour and Lopes Lara will answer the summonses in Salt Lake County, where prosecutors must prove each count beyond a reasonable doubt if the case proceeds. The defence is expected to test the undercover evidence, the classification of the contracts and Utah law's reach over an out-of-state platform. Either outcome is likely to be appealed.
