Less than twelve hours after Democrats declared victory in both chambers of Congress, the party's senior Democrat on the House Education and Workforce Committee moved to lock down the paper trail. Representative Bobby Scott of Virginia has sent formal preservation notices to ten federal departments and agencies, demanding written assurance by November 18 that government records have not been destroyed — and warning that anyone who destroys them faces a fine, up to three years in prison and the loss of public office.

The November 4, 2026 letters went to the secretaries under the committee's jurisdiction, including Education Secretary Linda McMahon, Labor Secretary Keith E. Sonderling and Health Secretary Robert F. Kennedy Jr. The Guardian, which first reported the notices, said recipients also included Agriculture and the National Labor Relations Board.

Key Points

• Representative Bobby Scott, the ranking Democrat on the House Education and Workforce Committee, sent the notices on November 4, 2026, to ten Trump administration agencies.
• Each agency must confirm in writing by November 18 that its records "have not been and will not be concealed, modified, removed, transferred, destroyed, or otherwise rendered inaccessible."
• The Federal Records Act requires agency heads to preserve records of the agency's organisation, functions, policies, decisions and essential transactions.
• Wilfully destroying a federal record brings a fine and up to three years in prison; a convicted officeholder can also lose the post and be barred from future office.
• The notices come as Democrats prepare investigations ahead of the new Congress taking power on January 3, 2027.

What Happened

Scott's letters are short and blunt. They remind each agency head that federal law requires the preservation of all records and demand written assurance, by November 18, that no records, documents or information have been concealed, modified, removed, transferred or destroyed. The notices went out the morning after the November 3 midterm elections, in which Democrats won both chambers of Congress.

The committee oversees the Education and Labor departments, much of the health system, and agencies policing union elections and workplace disputes. Scott framed it as a direct consequence of the result. "The American people have given Congress a clear mandate to root out waste, fraud, and abuse within the [Trump] Administration," he wrote.

Background and Context

The Federal Records Act, passed in 1950, sits at the centre of the dispute. It requires every agency head to make and preserve records documenting the agency's organisation, functions, policies and decisions, and it makes wilful destruction of a federal record a criminal offence. The penalties — a fine and up to three years in prison — are modest, but the added sanction for officeholders, losing the post and disqualification from future office, is what gives the warning force.

Scott has used the same tool before: after the 2020 election he sought identical assurances from the departments of Agriculture, Education, Health and Labor. The warning also follows a year of Democratic complaints about vanishing documents, including reports that OSHA removed workplace-safety guidance. Preservation letters are now routine in this year's oversight fights: the Justice Department warned election officials in all 50 states about the 22-month rule for election records, and bipartisan letters told banks and ports to preserve records linked to a Russian diesel deal.

Federal Records at the Centre of the Fight

What counts as a federal record is broad: emails, memos, meeting notes, drafts and databases, not only the final signed version. Scott's letters use that breadth, demanding assurance that nothing has been "concealed, modified, removed, transferred, destroyed, or otherwise rendered inaccessible."

Records rarely vanish in a bonfire. Files are moved to personal accounts, reclassified, archived where the new majority cannot reach them, or deleted as routine housekeeping — and each act is covered by the assurance Scott demands. The November 18 deadline falls six weeks before the new Congress is seated on January 3, 2027, giving the committee time to check the assurances against what investigators find, and to follow up with subpoena power if an answer does not match the files.

Reactions and Quotes

Scott's own words set the tone: the notices remind agency heads that the law requires them to preserve "adequate and proper documentation" of everything their agencies do, and that the committee will be checking.

The Guardian stressed the same point: the request is not a courtesy. The letters cite the Act's criminal penalties and set a fixed date for reply, turning a routine reminder into a dated demand that can be produced later in an investigation. The agencies have until November 18 to reply, and the committee is expected to judge them on those replies.

Why It Matters

Records are the raw material of oversight. Without them, an investigation into waste, fraud or abuse becomes a contest of competing memories, with no paper to settle it. With them, a committee can trace who decided what, when, and on whose instruction — which is why preservation notices are the first move of every incoming majority, and why destroying records is a crime, not an administrative lapse.

The stakes are higher than usual given what Democrats intend to investigate: spending decisions, workforce cuts, health and education programmes and the use of emergency powers. Each inquiry will start from the files the agencies hold now. A notice also puts every official on written notice that destruction after this date cannot plausibly be called an accident.

What Happens Next

The first test comes on November 18, when the assurances are due. Staff will log which agencies replied, what they promised and whether any hedged.

The second test comes on January 3, 2027, when the new Congress is seated and Scott is expected to take the gavel as chair. From that day it can issue subpoenas, compel testimony and demand documents, with the notices as its baseline for measuring cooperation. If records turn out incomplete, the committee can refer the matter to the Justice Department or National Archives — but for now the message is simple, and written down: save everything.
