The National Capital Planning Commission on Thursday approved the final plans for President Donald Trump's 250-foot triumphal arch at Memorial Circle, clearing the last federal planning hurdle for one of the most contested monuments in modern Washington history and opening the way for construction to begin immediately.

The commission approved the arch's height, its final site and building plans, road changes around the circle and a "non-standard eternal flame" in the hand of its winged Lady Liberty statue. The vote followed hours of testimony in which speaker after speaker opposed the project, and a crash of the hearing's online link that cut off the remaining speakers.

Key Points

• The National Capital Planning Commission approved the final plans for the 250-foot triumphal arch at Memorial Circle on Thursday, November 5, 2026.
• The 166-foot stone arch, topped with three gilded figures, reaches 250 feet and would hold about 400 visitors, with an eternal flame in Lady Liberty's hand.
• More than 130 people signed up to testify; almost all who spoke called it a vanity project built without Congress's approval.
• Judge Tanya Chutkan ordered the government to notify her within an hour of the decision and give 30 minutes' notice before any construction.
• Trump wants it finished before he leaves office in January 2029; the Justice Department says construction would take 33 to 39 months.

What Happened

The commission met on Thursday to consider the final plans submitted by the Interior Department, and its chair, Mark Paoletta, had vowed to pass the measure even if the meeting stretched past midnight. The afternoon vote approved the monument in full: its height, its footprint, the curb cuts on Memorial Avenue, the traffic plan for Washington Boulevard, new crosswalks and the flame.

The arch was designed by Nicolas Leo Charbonneau of Harrison Design: a stone arch 166 feet tall, topped with three gilded figures — a winged Lady Liberty at the centre — reaching 250 feet, with observation decks, offices and space for about 400 visitors. Paoletta called it "the grandest arch ever built by mankind" and a "generational security opportunity". The commission said the arch's security functions were filed under seal, but the documents it reviewed show no security component.

Background and Context

The arch is meant to commemorate the nation's 250th anniversary, the American spirit, the military and American "competence", in the White House's words. It would stand at Memorial Circle, where Arlington Memorial Bridge meets Washington, D.C., beside Arlington National Cemetery and on the Lincoln Memorial sightline. The commission approved preliminary plans on July 9 and the Commission of Fine Arts approved the design in the spring.

But an August review by the National Park Service found the arch would have "adverse" effects on as many as 42 historic sites, including the cemetery and the Lincoln Memorial corridor, and last month the administration ended the Section 106 historic-preservation review. Opponents — the District of Columbia, Virginia, veterans and preservationists — say the project lacks congressional authorisation under the Commemorative Works Act. The administration cites a 1925 law tied to Arlington Memorial Bridge. At an October 30 hearing, Judge Chutkan asked: "It doesn't make the use of national security talismanic in this case," and "What's the rush to put this arch up?" The approval came two days after Democrats swept both chambers in the midterms, and the White House wants the project locked in before the new majorities take power in January.

Trump's 250-Foot Triumphal Arch: What the Approval Covers

The commission's vote settles the planning questions, but not the arch. It covers the final plans, the 250-foot height, the road and crosswalk changes and the eternal flame — not the legal authority to build, which is before Judge Chutkan, nor the money or timetable. Critics say the concrete-and-granite monument, with its gilded eagles and winged figure, is wildly out of keeping with Memorial Circle, and the Park Service warned it would diminish the historic landscape. The District and Virginia also raised traffic, emergency access and Potomac stormwater runoff in their lawsuit.

Reactions and Quotes

Paoletta was the project's most forceful champion, and the White House calls the arch a centrepiece of Trump's effort to reshape Washington for the 250th anniversary. The opposition was just as blunt: speaker after speaker called it a vanity project advanced without Congress's approval or the required environmental and historic-preservation reviews.

The District and Virginia, in their joint lawsuit, called the project "flagrantly unlawful" and warned: "As soon as Defendants break ground on this project, they will inflict irreparable harm on both the District and Virginia." Chutkan has ordered the government to tell her of any decision within an hour and give 30 minutes' notice before construction; her order would not, on its face, stop groundbreaking. On Thursday, the Park Service also admitted in court that its construction company had marked the site without permission.

Why It Matters

The approval is the closing step in pushing through one of the central projects in Trump's quest to reshape the capital. With Democrats about to take Congress in January, the administration is racing to lock it in before a new Congress can stop it or cut its funding. It also sets a precedent: if a president can build a 250-foot arch on federal land without Congress's authorisation, citing a century-old bridge law and a sealed security filing, the Commemorative Works Act loses much of its force — and the monument would permanently dominate the gateway to Arlington National Cemetery.

What Happens Next

The first test comes within hours. Under Chutkan's order, the government must notify her within an hour and give 30 minutes' notice before construction, and opponents are expected to seek an emergency order blocking groundbreaking. If no court blocks it, excavation could begin at once on two daily 10-hour shifts, with above-ground work not before May 2027. Even on the government's 33-to-39-month timetable, the arch would not be finished before Trump leaves office in January 2029.
